    As a 20 year veteran School Psychologist now in private practice as a Licensed Educational Psychologist, I agree with your premise of the inequity in the delivery of an appropriate education. However, the problem is that public schools are not in compliance with [vi] 20 USC 1414(b)(2). School districts dp not use a variety of instruments to assess children. Most school districts administer the Wecshler Intelligence Scale for Children exclusively because their budgets do not allow them to purchase a variety of assessment instruments. The private evaluator used different instruments which measured and documented what she was looking for.
    It is not so much a matter of the law, as it is the fact that public schools have not evolved to come within the letter of the law. The practice of school psychology in most schools is a farce. There is no psychology involved, there are so many students needing evaluation that testing is all most school psychologists get to do, and they don’t have a variety of instruments with which to do it. Any private practitioner will do a better job of assessment because the School Psychologist’s hands are tied by a lack of tools with which to do their job.
    Parents are also at fault because they do not take the care with child rearing that they should. The schools have to education the child that comes to them. It would be well if the law held the parents somewhat responsible encouraging them to rear children ready to learn. Research indicates that the relationship that the parent has with his child has a greater impact upon his ability to learn than any other factor. Nutrition, exposure to toxins, lack of sleep, and all the other causes of learning disabilities are under the control of the parent. Also, the kind of education that a child receives is controlled by the parent as outlined in No Child Left Behind. The problem is that parents have many reasons for not being totally effective as parents, however, the responsibility remains wholly in their hands. It is time that someone stopped blaming the schools and rewarding wealthy parents because learning disabilities can be completely prevented and or reversed when the offending trauma is removed from the child’s environment. The incidence of learning disabilities is growing at the rate of 10 – 20% every 10 years. It is time that governments started to look at the causes in our environment rather than the failure of the schools to educate a child that does not have the neurological development needed to learn.

    While I do not disagree with the premise that parents should have the ultimate control over the education that their child receives and that lowering the barriers (mainly cost) to private instruction would empower parents in this regard – I do have a fundamental problem with vouchers and tax credits. Because of federal laws (usurping the State rights as they do), the private instruction would then no longer be private. Through vouchers and tax credits, private institutions would be forced by government regulation to become (virtually) the same as their public counterpart. Public money = public regulation

    This is just my opinion and in fairness I must disclose that I am an Oregon public school graduate with no college degree or professional training in the area of education (just a lay-person, so take it for what it’s worth).
